Is it time for the digital notary?

Today's global society is facing a vertiginous crossroads of change, driven by the globalization of the economy, the transformation of digital notaries in Mazatlán (and the rest of Mexico) and communications, whose main engine will be artificial intelligence.

In the economic sphere, the foreseeable prolonged social distancing is undoubtedly accelerating the digitalization of our economies, which is why the digitization of procedures in the area of preventive legal security is more than contemplated. To the extent possible, avoiding travel to notaries and registries is not only a complaint of citizens, but also an essential objective for the process of Flexibilization generated by the so-called “new normal”.

The ideal of our digital notary office in Mazatlán and this digitization should be organized on a double plane: the generalization of the use of the digital public document, disappearing the paper document (or leaving it as a mere reliable backup that will be mentioned in the brief), and the provision of certain remote grants through videoconference and electronic means of identifying people.

The first requires giving digital form to the notarial public document: matrix and copy. The paper matrix must be unfolded on the spot, replicating it in a digital version and continuing to be used in that format. This innovation is not urgent, but it would be appropriate to take advantage of the other modifications that are being made to introduce it, due to the undoubted advantages it will have for users, in terms of costs and transparency.

Authorized copies of public documents must be issued only in digital format, avoiding the movement of people and paper between homes, notaries and other public offices. Thus, meeting the requirements of the digital environment, copies must incorporate business metadata, in formats operable with the public or private entities that must manage them, and thus be available to legitimate public entities to access their content.
