Is the notary system of public notaries in Mazatlán the same as the rest of the world?

Notaries public in Mazatlán and other countries around the world have the capacity to keep in touch thanks to globalization, driven especially by economic matters. For it to be possible to carry out successful and secure business relationships, it is of vital importance that the Law be kept present and updated and tenacious. However, we must remember that laws are not the same everywhere.

As we have already identified, the primary function of the notary is public faith, impartial advice and the control of legality. Therefore, notaries public in Mazatlán, as well as those in the rest of the world, are responsible for ensuring compliance with the laws in their jurisdiction.

The notary system is of strategic importance for the optimal functioning of economic life, since it is a figure that protects consumers, saves costs by providing free advice to the user, reduces and speeds up the corresponding procedures to a certain extent and avoids litigation.

People around the globe have similar needs, so simple that they range from drafting a will to establishing a company. However, it is not possible to make an exact comparison between the way in which these processes will be carried out in Mexico and in Spain.

Unlike private contracts, the enforceable force attributed to public notarial  documents allows contracting parties to directly obtain the execution of their reciprocal obligations before the courts. The public document also has an effectiveness that transcends third parties.

There are bodies that are responsible for taking care of and regulating notaries, including:

• The International Union of Notaries (UINL), a non-governmental organization that includes most of the countries of the European Union and Latin America -where notaries public are located in Mazatlán-, countries in Eastern Europe and some in Asia and Africa.

• The Council of Notaries of the European Union (CNUE), an official body representing the notary profession before European institutions.

In conclusion, regardless of the terrestrial location, the nature of the user or, even, the government in charge, the need for a notary system prevails.
